Monster Energy Drink – Corporate America Gone Bad
There is something wrong with the American justice system. On September 14, 2009, the owners of Rock Art Brewery were sent a cease and desist letter to stop making their Vermonster beer by the owners of the piss-tasting Monster Energy drink, the Monster Beverage Company (by email, cheap bastards) . The claim made by Monster Beverage has no legitimate legal standing in this case but in America, you don't need anything but more money than your competitor to drive them out of business.
The Claimed Confusion
The lawyers representing the Hansen Beverage Company claim that Vermonster can be confused with their own energy drink. Come again? Not only are the words "monster" and "vermonster" (a portmanteau of "Vermont" and "monster" – it's brewed in Vermont) different, but they represent two different kinds of beverages.
I'm sorry, but you would have to be a retard of the third kind in order to confuse the two drinks. Vermonster is an incredibly stout, American barley wine while the Monster Energy drink tastes like camel piss and contains no alcohol content whatsoever.
Self-Defense of the Best Kind
The cease and desist letter reeks of a SLAPP but isn't. The owners of Vermonster would be able to defend themselves against a SLAPP.
Although they've been advised against it, Matt and Renee (the husband and wife owners) are going to fight this legal battle with all the support they can muster. It's people like me and you, making it public and getting the media on our side, which will force corporations like Monster Beverage to rethink their legal strategies.

Allyn Hane, owner of Blogger Illustrated and master of his own domain, publicized his thoughts about this fiasco with words that I won't repeat here. He would like nothing better than to see the Monster Beverage Company go bankrupt as a result of these heavy-handed tactics. He loves beer, all kinds of beer, and people attacking beer companies that he likes are at the top of his crap company list.
I've never tasted Vermonster and I probably never will. I don't live in the US anymore and even if I return, I doubt I would be enough of a beer connoisseur to chase down a few bottles of it. It doesn't matter — stuff like this pisses me off to no end. I'm going to do my part to publicize this threat and I hope you'll do the same.
